TheMotorcycleLawyer.com SWEEPSTAKES (the “Sweepstakes”) is offered only in and may be entered in the state of Michigan. Sweepstakes begins at 12:01 AM Eastern Daylight Time (EDT) on March 1, 2007 and ends at 11:59 PM EDT on August 27, 2007 (“Sweepstakes Period”). The next Sweepstakes Period shall be September 28, 2007 until 30 days before the next scheduled las Vegas Bike Fest and every year thereafter until specifically revoked.

ELIGIBILITY: The Sweepstakes is open only to legal residents of the state of Michigan, who possess a valid U.S. driver's license and are 21 years of age or older at time of entry. The “Sweepstakes” is offered only in the state of Michigan. Employees, and their immediate families (spouses and siblings, parents and children and their spouses) and household members, of any of the "Sponsors", and their respective affiliates, subsidiaries, divisions, dealers, advertising and promotion agencies (“Sweepstakes Entities) are not eligible. Void where prohibited.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, each entrant fully and unconditionally accepts these Official Rules and the decisions of the Sponsors and the Administrator, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Noncompliance with the Official Rules will result in disqualification and the forfeiture of any prize.

HOW TO ENTER: To enter the sweepstakes complete the sweepstakes entry form on the website of: TheMotorcycleLawyer.com during the sweepstakes period. Each person may fill out one entry form a year. No mechanical reproductions permitted. Limit of one entry per person. In the event duplicate entries are received from any one person, the Sponsor(s) may void his/her entry to the Sweepstakes. Multiple entries from the same person may be disqualified. Only one name shall be on an entry form. Sponsors are not responsible for late, lost, illegible, damaged entries or entries that are lost or damaged because of a computer problem. Entries become the property of the Sponsor and will not be returned. By entering or filling out the entry form, you authorize mailing of promotional materials and emails to you by the sponsors and their affiliates.

PRIZES/APPROXIMATE RETAIL VALUE (ARV): Two admission tickets to the Las Vegas Bike Fest and two coach airfare tickets with the approximate total value of four hundred and fifty dollars (ARV $450) will be awarded; Winners are responsible for all taxes (federal, state and/or local) and any other expenses not listed, which relate to acceptance and use of prize. Winners are responsible for all costs associated with any available upgrade/option packages, hotel, housing and must take delivery of prize one week before the Bike Fest show. Prior to taking delivery of the prize, winner must provide valid driver's license and name of companion for air tickets.

WINNER SELECTION AND VERIFICATION: The winners will be selected in a random drawing on or about August 28, 2007 from among all eligible entries received. In the years thereafter, the drawing shall be done on or about 30 days before the Bike Fest Show. The process of will be that one entry form shall be drawn. The odds of winning depend on the total number of eligible entries received. Drawings will be conducted by an independent person who has a professional license such as a CPA or attorney selected at the Sponsors sole discretion and may be Jason Waechter. Winner of the grand prize may be required to complete an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release form within seven (7) days of receipt. Failure to timely sign, complete and return any required executed forms will cause the prize to be forfeited and awarded to an alternate winner. Except where prohibited by law, entry and acceptance of a prize constitutes permission for Sponsors to use winner's name, home town, likeness, statements and other personally identifiable information and photo(s) for advertising and marketing of Sponsor's’ products, services and consumer promotions in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winner will provide written consent to such use. Winner may not transfer, exchange or redeem any Prizes for cash; however sponsors reserves the right to substitute, in whole or in part, a prize of comparable or greater value at its sole discretion. If a prize is refused, a prize notification is returned or deemed undeliverable, the contact information is no longer valid (phone number disconnected or address no longer valid) or potential winner is disqualified for any reason, an alternate winner will be selected.

RELEASE AND DISCLAIMER OF LIABILITY: Sponsors and their respective agents are not responsible for 1) any error, omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials or any human errors; 2) for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission or processing of, or failure of Sponsors or agents to receive entry information on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof; 3) any injury or damage to entrant's or any other's person or property, including but not limited to entrant’s computer related to or resulting from participation in the Sweepstakes; 4) entries that are late, lost, misdirected, illegible, damaged, postage-due or otherwise deficient; 5) the cancellation or rescheduling of any Event. Sponsor reserves the right, in its sole discretion, to terminate, cancel, suspend or modify the Sweepstakes in its entirety, or any portion thereof if its integrity, fairness or proper operation is undermined, or corrupted as a result of technical or other reasons or because of any illegal or non-authorized intervention or any other factor beyond Sponsor’s’ reasonable control. In that event, Sponsor may select the grand prize winner from all eligible entries received prior to such modification or cancellation and will post notification of such action on www.themotorcyclelawyer.com. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. By entering, participants (a) agree to be bound by these Official Rules and the decisions of the Sponsors and Administrator, which shall be without legal or other recourse and final in all respects; (b) release all Sponsors and its respective divisions, dealers, subsidiaries, affiliates, and advertising and promotion agencies and their respective directors, officers, lawyers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (c) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, the quality of the show or all features planned or specified on the Las Vegas Bike Fest’s webpage or other promotional materials.. Noncompliance with the Official Rules will result in disqualification and the forfeiture of any prize.

PRIVACY: Information collected in connection with this Sweepstakes may be shared with Sponsor's’ promotional partners. By entering the entrants authorize mailing of promotional materials and emails to them by the sponsors and their affiliates and promotional partners.

DISPUTES: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration in Oakland County, Michigan, USA. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan USA. Any and all claims, judgments and/or awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorney’s fees. In the event of any dispute between the Parties as to the terms of this Agreement, or any matters arising under the terms of this Agreement, the same shall be settled only by arbitration in the City of Southfield, State of Michigan, in accordance with the rules and regulations of the American Arbitration Association (AAA). The determination of the arbitrators shall be final and binding upon the parties and may be enforced in any court of appropriate jurisdiction. The AAA will not conduct the arbitration, but each side shall pick a licensed Michigan attorney to act as an arbitrator and those arbitrators shall pick a neutral. The three arbitrators shall decide the dispute. Each party is responsible for the fees to the arbitrator of their choice and the neutral’s fees shall be split by each side. The decision or agreement of only two of the three arbitrators shall be needed to render a decision/award.
