Ø      Nebraska is an at-fault state. This means that the law of negligence governs Nebraska motorcycle and Nebraska motor vehicle accidents. § 60-1401.02. Terms, defined.

 

(6) Motor vehicle means any vehicle for which evidence of title is required as a condition precedent to registration under the laws of this state but does not include trailers;

 

(11) Motorcycle means every motor vehicle, except a tractor, having a seat or saddle for use of the rider and designed to travel on not more than three wheels in contact with the ground and for which evidence of title is required as a condition precedent to registration under the laws of this state;

 

Ø      Nebraska Helmet Law:  When riding on or operating a Nebraska motorcycle, you are required by law to wear a helmet.

 

Neb.Rev.St. § 60-6,279

§ 60-6,279. Protective helmets; required; when.

A person shall not operate or be a passenger on a motorcycle or moped on any highway in this state unless such person is wearing a protective helmet of the type and design manufactured for use by operators of such vehicles and unless such helmet is secured properly on his or her head with a chin strap while the vehicle is in motion. All such protective helmets shall be designed to reduce injuries to the user resulting from head impacts and shall be designed to protect the user by remaining on the user's head, deflecting blows, resisting penetration, and spreading the force of impact. Each such helmet shall consist of lining, padding, and chin strap and shall meet or exceed the standards established in the United States Department of Transportation's Federal Motor Vehicle Safety Standard No. 218, 49 C.F.R. 571.218, for motorcycle helmets.

 

Ø      Nebraska Eye Protection Law: When riding on or operating a Nebraska motorcycle, you are not required by law to wear eye protection.

 

Ø      Nebraska Motorcycle Minimum Insurance Requirements: The minimum insurance required for your Nebraska motorcycle is compulsory liability insurance. The limits required for your Nebraska motorcycle are 25/50/25.

 

·        Bodily Injury Liability (1 person): $25,000

·        Bodily Injury Liability (All persons, 1 accident): $50,000

·        Property Damage Liability: $25,000

 

Ø      Nebraska Motorcycles: UIM Coverage: If you are injured in a Nebraska motorcycle accident, by an at-fault driver who does not have any insurance, or adequate insurance, to cover your claim, uninsured or underinsured motorist coverage may protect you in this situation.

 

·        Uninsured Motorist Coverage: Uninsured motorist insurance will protect you if you are involved in a Nebraska motorcycle accident with an at-fault driver who does not have ANY insurance to cover your claims.

 

·        Underinsured Motorist Coverage: Underinsured motorist insurance will protect you if you are involved in a Nebraska motorcycle accident with an at-fault driver who does not have ADEQUATE insurance to cover your claims.

 

Neb.Rev.St. § 44-6405

§ 44-6405. Uninsured motor vehicle, defined.

Uninsured motor vehicle shall mean a motor vehicle with respect to the ownership, operation, maintenance, or use of which:

(1) There is no bodily injury liability insurance or bond applicable at the time of the accident;

(2) There is bodily injury liability insurance or a bond applicable at the time of the accident but the insurer writing such insurance or bond (a) denies coverage or (b) is or becomes insolvent as described in section 44-2403 within four years after the time of the accident which occurred while the named insured's uninsured motorist coverage was in effect;

(3) The owner or operator is unknown and bodily injury, sickness, disease, or death of an insured results from actual physical contact between such motor vehicle and the insured or a motor vehicle occupied by the insured; or

(4) The owner or operator is unknown and bodily injury, sickness, disease, or death of an insured is caused by such motor vehicle without actual physical contact between such motor vehicle and the insured or a motor vehicle occupied by the insured if (a) the accident has been reported, as required by law, to the proper law enforcement authorities and (b) the facts of the accident can be corroborated by competent evidence provided by an independent and disinterested person and not by the insured or any person occupying the insured motor vehicle.

Ø      Nebraska Statute of Limitations: The statute of limitations in Nebraska for a negligence or personal injury case is 4 years from the date of your Nebraska motorcycle accident. If you are planning to commence suit against the at-fault driver that caused your Nebraska motorcycle accident, you must do so within 4 years.

 

Neb.Rev.St. § 25-207

§ 25-207. Actions for trespass, conversion, other torts, and frauds; exceptions.


The following actions can only be brought within four years: (1) An action for trespass upon real property; (2) an action for taking, detaining or injuring personal property, including actions for the specific recovery of personal property; (3) an action for an injury to the rights of the plaintiff, not arising on contract, and not hereinafter enumerated; and (4) an action for relief on the ground of fraud, but the cause of action in such case shall not be deemed to have accrued until the discovery of the fraud, except as provided in sections 30-2206 and 76-288 to 76-298.
