        <description><![CDATA[<p>This is the month! May is Motorcycle Safety Awareness Month! Whether you are a long time rider or just bought your first bike last week, THE&#160;Motorcycle Lawyer thinks it's always a good idea to brush up on some safety tips before hitting the open road!</p>
<ul>
<li>Always be alert! BUT especially at intersections. Roughly 50% of all motorcycle-vehicle accidents occur at intersections. The most common is a vehicle turning left in front of a motorcycle, so always be prepared to act quickly.</li>
</ul>
<ul>
<li>Glancing in your mirrors before switching lanes or coming to a stop could prevent a rear-end collision.</li>
</ul>
<ul>
<li>Watch the road a distance ahead of you so you are aware of any hazards or traffic issues before you are upon them.</li>
</ul>
<ul>
<li>So many motorcyclists ride by this common tip: “Assume you are invisible to other motorists on the road and operate your motorcycle accordingly.” Ride to be seen, take up a lane and ride in it where you will be noticed by motorists. Headlights are a must during the day and night. Wearing reflective and bright clothing helps any motorcyclist be seen.</li>
</ul>

<li>Ride at a speed that is appropriate for the road conditions, i.e. weather, traffic, or construction.</li>
</ul>
<ul>
<li>Treat other vehicles &amp; motorcycles with courtesy and respect.</li>
</ul>

<li>Avoid tailgating and riding in between lanes.</li>
</ul>
<ul>
<li>Always use signals when necessary.</li>

        <title>Deal struck: Audi to Buy Ducati</title>

        <description><![CDATA[<p>Audi will be taking Ducati under its Volkswagen wing. Although neither Audi nor the current owner of the motorcycle brand, an Italian Investment company Investindustrial, have made a formal statement, the deal is estimated to be for $1.1 billion.</p>
<p>&#160;</p>
<p>Looking at the overall value of the company, taking into account the deal on the table and subtracting the company’s debt, the actual value of Ducati is estimated to be seven times that of its profit from 2011 (discounting interest and taxes). The liabilities as of last month were reported by Investindustrial to be less than $262.7 million, (VW’s Audi Nears Purchase of Ducati, Christoph Rauwald, The Wall Street Journal,</p>

<p>The famous motorcycle company was founded back in 1926, and has proven itself in standard having won 17 manufacturer’s World Championship titles, and holding the current 2011 World Superbike Championship title. So it comes as no wonder why the Chairman of Volkswagen Ferdinand Piech, who celebrated his 75 birthday this past Tuesday, has eyed the company for years, having tried to purchase it previously in 2008, (VW’s Audi Nears Purchase of Ducati, Christoph Rauwald, The Wall Street Journal).</p>
<p>&#160;</p>
<p>Ducati will become the 11th brand under Volkswagen. It looks like it will fit right in with Audi’s Superbike 119 Panigale S Tricolore, and upping the ante in the company’s motorcycle competition between BMW models.</p>
<p>&#160;</p>
<p>42,000 Ducati motorbikes were sold in 2011, accumulating to $630.2 million. However, Christoph Stuermer, a Frankfurt analyst with IHS Automotive believes that “Ducati is one of the finest machines you can buy,” but that the company is “mere accessory and insignificant for Volkswagen,” (VW’s Audi Nears Purchase of Ducati, Christoph Rauwald, The Wall Street Journal).<br />

        <title>Motorcycle Helmets NOW OPTIONAL in Michigan</title>

        <description><![CDATA[<p>The proposed motorcycle helmet law, Senate Bill 291, has now become law. Governor Rick Snyder announced this decision today, April 13th, 2012.</p>
<p>&#160;</p>
<p>The new law lessens helmet restrictions allowing motorcycle operators to ride without a helmet provided they are 21 years of age or older, have at least $20,000 of first-party medical benefits insurance coverage, and either have had a motorcycle endorsement for more than two years OR earn a motorcycle endorsement by passing an accredited or certified motorcycle safety course.</p>
<p>&#160;</p>
<p>A passenger on a motorcycle may ride helmetless under the new law if the passenger is at least 21 years of age and is also covered for at least $20,000 of first-party medical insurance benefits (either by the operator's cycle insurance or their own). So, if you were to ride with a passenger, you may need an additional $20,000 of this medical coverage in addition to the $20,000 you require as the operator.</p>
<p>&#160;</p>
<p>Proponents of the new law argued that being able to choose whether or not to wear a helmet is a freedom. They also point out that Michigan's tourism industry is presently negatively impacted because riders from our neighboring states do not have to wear a helmet (Indiana, Ohio, Illinois, &amp; Wisconsin) and, therefore, avoid Michigan destinations.</p>
<p>&#160;</p>
<p>Opponents of the new law argued that statistics report greater head injuries to helmetless riders. These injuries result in an increase in medical costs (to the government and to insurance companies), and a resulting increase in our no-fault insurance rates.</p>
<p>&#160;</p>
<p>Passing a similar law was attempted twice during Gov. Jennifer Granholm's tenure, but was vetoed on both of the attempts. The present law was sponsored by State Senator Phil Pavlov, R-St. Clair Township. Governor Snyder stated in a news release that, "While many motorcyclists will continue to wear helmets, those who choose not to deserve the latitude to make their own informed judgments."</p>
<p>&#160;</p>
<p>In an interview with a news reporter, Jason was asked; "How will the new law impact a civil negligence case of a motorcyclist who was not wearing a helmet?"</p>
<p>His answer: I think defense attorneys will argue that not wearing a helmet was unreasonable and that not wearing a helmet was a cause of some injury or severity of injury to the motorcyclist.&#160; If the jury agrees, it would assess a percent of negligence against the motorcyclist and that percentage would be subtracted from the dollar amount awarded by the jury.&#160; If the jury decides that the motorcyclist was more than 50% negligent, the motorcyclist will get no money damages for his or her injury.</p>

        <title>Motorcycle Accident Takes the Lives of Two Vietnam Veterans</title>

        <description><![CDATA[<p>This past Saturday during the Veterans’ Celebration at the Charlotte Motor Speedway track, two Vietnam veterans collided on their motorcycles, the results fatal for both of them.</p>
<p>&#160;</p>
<p>Witnesses at the event reported that motorcyclists were riding around the track going in opposite directions prior to the collision of Thomas Franklin Hollingsworth, 71, of Piedmont, South Carolina, and Alan Richard Mockus, 66, of Alto, Georgia.</p>
<p>&#160;</p>
<p>The coordinator of the Rolling Thunder, a motorcycle club consisting of mostly Vietnam veterans, Barry Burke, stated that motorcyclists were informed prior to the start of the event that they would only be permitted to ride up to 35 mph, and only during the opening and closing processions. Both Hollingsworth and Mockus were traveling at 50 mph, about a half-hour after the closing of the event.</p>
<p>&#160;</p>
<p>The head-on accident happened at a steeply banked turn and Police Major Allen Overcash stated that “we have some evidence that one of the gentlemen may have been drinking,” (Vietnam vet deaths: Motorcycle at 50 mph before head-on crash, David Zucchino, Los Angeles Times,<br />

        <title>Three Motorcyclists in Accident in Clarksville, TN</title>

        <description><![CDATA[<p>Three motorcyclists all on their own bikes were hit by a Pontiac Grand Am on Wednesday night in Clarksville, Tennessee.</p>
<p>&#160;</p>
<p>The three motorcyclists, Richard Brewster, Tommy Tuchscherer and Amber Tuchscherer, were going through the intersection of Fort Campbell Boulevard and Lafayette Road, when the driver of Grand Am, Martha Gilbreath, turned left from Fort Campbell onto Lafayette in front of them causing the collision. Police stated that the traffic light was green in both directions, (Car hits three motorcycles in Clarksville, Andy Humbles, The Tennessean,</p>

<p>Both Brewster and Tommy Tuchscherer were airlifted by helicopter to Vanderbilt University Medical Center. Brewster suffered from a serious injury to his leg while Tuchscherer sustained internal injuries. Both have been reported to be in stable condition.</p>

        <content:encoded><![CDATA[<p>Three motorcyclists all on their own bikes were hit by a Pontiac Grand Am on Wednesday night in Clarksville, Tennessee.</p>

<p>The three motorcyclists, Richard Brewster, Tommy Tuchscherer and Amber Tuchscherer, were going through the intersection of Fort Campbell Boulevard and Lafayette Road, when the driver of Grand Am, Martha Gilbreath, turned left from Fort Campbell onto Lafayette in front of them causing the collision. <p>Both Brewster and Tommy Tuchscherer were airlifted by helicopter to Vanderbilt University Medical Center. Brewster suffered from a serious injury to his leg while Tuchscherer sustained internal injuries. Both have been reported to be in stable condition.</p>

<p><font size="3">As Michael Babb, 34, made a left turn into a driveway, motorcyclist Marty Sandridge, 43, and passenger Jordan Best, 18, attempted to pass Babb’s and another’s vehicle, resulting in Babb’s striking the motorcycle.</font></p>

<p><font size="3">On the scene BCSO deputies Casey Kerr and Tim Bohannon performed CPR on Best before paramedics and Fire Rescue officials showed up at the accident. Best was transported to Sky Ridge Medical Center and Sandridge to Erlanger Medical Center.</font></p>

<p><font size="3">Best was pronounced dead upon arrival at Sky Ridge Medical Center. Sandridge suffered from injuries to the legs and arms. Babb sustained no injuries from the accident.</font></p>

<p><font size="3">The occupants of the other vehicle stayed after the accident to provide assistance and information regarding the happenings of the crash, but left the scene without disclosing their names.         <title>AMA&#039;s Motorcyclist of the Year in 2011</title>

        <description><![CDATA[<p><font size="3">Looking back on 2011, there have been a lot of influential people that have caused ripples of change. One person in particular is being recognized by the American Motorcycle Association (AMA) as the AMA Motorcyclist of the Year for 2011, Nancy Sabater. You may already know the story, but if not Sabater’s story is one of hard work, persistence, and believing in making a change.</font></p>
<p><font size="3">&#160;</font></p>
<p><font size="3">In August 2008 President George Bush signed into law the Consumer Product Safety Improvement Act (CPSIA) which was passed because "inexpensive imported children’s toys were testing high for lead content which can present serious exposure risks for children," (The AMA Motorcyclist of the Year, American Motorcyclist, Jan. 2012). The CPSIA banned the manufacturing, importing, selling and distributing of products for children 12 and under that contained a trace of amount of lead and that products&#160;would undergo periodic testing.</font></p>
<p><font size="3">&#160;</font></p>
<p><font size="3">This sounds like a good thing, keeping children safe. However the wording of this law included the manufacturing, selling, and distributing of dirt bikes to children 12 and under since trace levels of lead can be found in parts of the bikes such as in the brake calipers and battery terminals. It made no difference that these parts were not accessible and/or highly unlikely that a child would place one of the lead based bike parts in&#160;his or her&#160;mouth.</font></p>
<p><font size="3">&#160;</font><font size="3">&#160;</font></p>
<p><font size="3">Sabater had been riding since she was 19 and her fiancé Billy Schlag, who&#160;had a professional motocross license in the 1980s, is deeply rooted in dirt biking as a family activity. Nancy believes that the sport has "been morphed into many different things, but the real sport of motocross racing is a real grassroots, family activity," (The AMA Motorcyclist of the Year, American Motorcyclist, Jan. 2012). It was this passion for the sport and knowing that "children are the future of the sport, and the thought that we would have to put riding aside and not do these family things greatly concerned me. We need kids to grow the sport, and without an exemption to the law, eventually the ban would have killed motorcycling," (The AMA Motorcyclist of the Year, American Motorcyclist, Jan. 2012) that made Sabater jump to action.</font></p>
<p><font size="3">&#160;</font></p>
<p><font size="3">It all began with Sabater’s effort to interview and video tape riders and their experience about riding. This would show what a huge part motocrossing really played in so many lives, and how the law would affect future generations if kids were not able to grow up riding. Sabater made a total of 20 videos that she posted on YouTube and a Facebook Page dedicated to the change.</font></p>
<p><font size="3">&#160;</font></p>
<p><font size="3">What really got litigators’ attention was the AMA Family Capitol Hill Climb on May 26, 2011. This organized event gathered over 200 activists from all over the states to raise awareness of the affects of this law on motorcycling families. Sabater dubbed those making a difference "moto-patriots." Wayne Allard, AMA VP of Government Relations states on the event, "the AMA and its members in new events to focus media attention on the issue, lobbied on Capitol Hill, and organized campaigns to encourage riders and parents to contact their federal lawmakers to exempt kids’ OHV’s from the CPSIA. When it counted, riders and parents responded," (The AMA Motorcyclist of the Year, American Motorcyclist, Jan. 2012).</font></p>
<p><font size="3">&#160;</font></p>
<p><font size="3">All the dedication of Sabater’s and AMA members paid off as on August 12, 2011, President Barack Obama signed into law H.R. 2715 which exempts kids’ OHVs from the CPSIA lead content limits. That same day the bill received unanimous approval from Senate. It was this victory that "demonstrated the fruits of our labors. Something really happened here. We effected change. We showed these kids that if you want something hard enough and you work hard enough that you get results. Who knows what battles we’ll fight next in D.C., for the AMA, for the rights of motorcyclists. This was a victory on many levels.</font></p>

<p><font size="3">The future of motocrossing no longer is threatened by the CPSIA law, and children and their families continue to enjoy the sport together. <p>This SMARTrainer consists of a cockpit much like that of an actual motorcycle, handlebars and seat, active throttle, clutch, front brake, shift lever that mimics a bike’s, and foot pegs with rear brake (Honda SMARTrainer-Wise up your riding skills with Honda’s SMARTrainer, Jeff Buchanan, Motorcycle.com,</p>

The system uses Honda’s proprietary software which creates seventeen different road environments on a computer screen in front of the rider and then the system responds to the rider’s reactions. <p>The specific purpose of the SMARTrainer is to provide a safe place for beginners to practice before jumping into a beginners’ riding course and then real-world riding. The program is set up to confront riders with real world dangers on the road like erratic traffic, bad drivers, merging vehicles, congestion, blind spots, etc., (Honda SMARTrainer-Wise up your riding skills with Honda’s SMARTrainer, Jeff Buchanan, Motorcycle.com). Although the SMART does provide all of these aspects, it is not a riding simulator and so does not produce any actual movement. Nonetheless, it is still a great education tool for riders.</p>

<p>At the end of a riding session, the program provides a performance review, not just from the rider’s perspective, but other vehicle’s as well. This is helpful in that it allows riders to physically see the results of their reactions to hazards and their interaction with other vehicles on the road. <p>The specific purpose of the SMARTrainer is to provide a safe place for beginners to practice before jumping into a beginners’ riding course and then real-world riding. The program is set up to confront riders with real world dangers on the road like erratic traffic, bad drivers, merging vehicles, congestion, blind spots, etc., (Honda SMARTrainer-Wise up your riding skills with Honda’s SMARTrainer, Jeff Buchanan, Motorcycle.com). Although the SMART does provide all of these aspects, it is not a riding simulator and so does not produce any actual movement. Nonetheless, it is still a great education tool for riders.</p>

<p>At the end of a riding session, the program provides a performance review, not just from the rider’s perspective, but other vehicle’s as well. This is helpful in that it allows riders to physically see the results of their reactions to hazards and their interaction with other vehicles on the road.         <description><![CDATA[<p><span style="font-size: 12pt">T</span>his past Sunday, November 6, more than 2,777 bikers traveled from Lawrence-Dumont Stadium to Kansas Coliseum as part of the 32nd Annual Wichita Toy Run.</p>

<p>The run has grown more and more each year since its origin in 1980, starting out with just 30 riders to the present day count up to almost 3,000. Thousands of toys are gathered and other holiday items for the Salvation Army, Toys for Tots, and Kansas Food Banks each year during the ride.</p>

<p>Unfortunately this year there were two motorcycle accident during the event. The first accident occured at 25th and Broadway when a motorcyclist lost control of his bike. He and his female passenger fell off the bike and were taken to Via Christi Hospital. The two suffered from serious injuries. The second accident happend in the 6900 block of North Broadway and involved a bike and a rider says the&#160;911 dispatcher. Both involved in this accident received minor injuries. Holly Potelle, the director of the event, involved since the very first run in 1980, said "it has been a long time since we had an accident, since we even had problems. You just never know with this many motorcycles,"</p>

        <title>Cleveland Browns&#039; Marcus Benard&#039;s Motorcycle Accident Ends his Season</title>

<p><font size="3">The accident occurred shortly after practice on Monday, October 10, their first day back from bye week. Ninety minutes after practice on Interstate 71 Benard crashed his motorcycle. Benard was traveling at a "high rate of speed" causing him to lose control of the bike crossing over four lanes until crashing into a guardrail, a witness told police on the scene. I’m very disappointed for him and for us." <p><font size="3">The accident occurred shortly after practice on Monday, October 10, their first day back from bye week. Ninety minutes after practice on Interstate 71 Benard crashed his motorcycle. Benard was traveling at a "high rate of speed" causing him to lose control of the bike crossing over four lanes until crashing into a guardrail, a witness told police on the scene. Police confirm there were no other vehicles involved and that the investigation has come to a close, (Report: Browns to pay Marcus Benard, The Associated Press,</font></p>

<p><font size="3">Although the injury was non-football related, the Browns have decided to pay Benard for the remainder of the season, which is roughly $375,000. <p><font size="3">As an undrafted free agent in 2009, his rookie season, the first nine games Benard was on the practice squad until he was signed to the active roster and played in the last six games with 3 ½ sacks. <p><font size="3">Cleveland Browns coach Pat Shumur had said last week that there was a future for Benards with the Browns. Defensive Coordinator Dick Jauron says on Benard’s accident "It’s so devastating for the young man. He was just starting to get back from preseason injuries and setbacks. It’s a big disappointment. I’m very disappointed for him and for us." Although this is a blow to Benard and the team, of course all are grateful that it wasn’t more serious and "thankful that he’s still with us," Jauron.</font></p>]]></content:encoded>

        <title>Witnesses become rescuers in fiery accident</title>

        <description><![CDATA[<p>In the college town of Logan on September 14, 2011 witnesses of a major motorcycle accident became rescuers when students, officers, and passer-bys lined up to lift the 4,000 pound BMW involved in the accident allowing student and motorcyclist Wright to be removed from under the car.</p>

<p>The accident occurred near Utah State University where Wright was headed on his motorcycle, to study. A BMW pulled out of a parking lot and as skid marks show, Wright laid his bike down as he slide along the road before colliding with the car. The bike then smashed into the car’s hood and bounced to the ground, while Wright slid underneath the car and both the motorcycle and car became inflamed, described Jeff Curtis, Assistant Logan Police Chief, (Students lift car off Utah motorcyclist after fiery crash, Jennifer Dobner, Sun Times, <a href="http://www.suntimes.com/news/nation/7651193-418/students-lift-car-off-utah-biker-after-fiery-motorcycle-crash.htmluntimes.com">http://www.suntimes.com/news/nation/7651193-418/students-lift-car-off-utah-biker-after-fiery-motorcycle-crash.htmluntimes.com</a>).</p>

<p>Nearly half a dozen witnesses lined up along the side of the car to take action, as they began to rock and then lift the car enough for a construction worker to finally be able to pull Wright from underneath the car and two officers to extinguish the flames. The rescuers are being dubbed ‘heroes’ and ‘angels,’ yet none wants to accept such a title. Abbass Sharif, a Utah State doctoral candidate and one of the rescuers said “That’s a big title. I don’t consider myself a hero. It’s just our humanity…Everyone is going to help.”&#160; Regardless of whether they are willing to accept a title or not, Curtis said he could “only speculate what the outcome would have been had none of the rescuers sprung to action.”</p>

<p>The 21 year old student Wright who was involved in the accident is “very thankful. They saved my life.” Tyler Riggs, Wright’s uncle says he does recall details of the accidents, being able to feel the heat of the flames, being under the car spitting up blood and unable to speak. Although Wright was not wearing a helmet he suffered no head trauma, but did have a broken pelvis, both legs broken, road rash, burns on his left foot and abrasions on the forehead. A statement from the hospital declares Wright’s condition as satisfactory.</p>

<p>There is no comment from the driver of the BMW, but one rescuer Matt Barney said “he was really worried about the safety of the young man; he was very emotional and shaken.”</p>

Unfortunately, everyone else is going to have that same idea, and with more motorcyclists and drivers on the road safety becomes an issue. If travel via motorcycle is a part your plan this Labor Day Weekend; keep these tips in mind to keep yourself safe.</p>
<p><br />
•&#160;Is your bike ready for long distance travel? Checking the tire pressure, headlights, and fluids prior to venturing on your trip can prevent several issues that could leave you stranded.</p>
<p><br />
•&#160;Know your exit. Besides keeping you aware of your next stop, drivers may make unforeseen lane changes to exit potentially causing an accident.</p>
<p><br />
•&#160;Be seen! Make sure to wear bright, reflective clothing to stand out and be seen by others on the road.</p>
<p><br />
•&#160;Map out or GPS your route. In an unfamiliar area knowing the road and possible construction areas will make you aware of upcoming lane changes and basic surroundings.</p>

•&#160;Give yourself time. Leave a little earlier than originally planned; this allows for possible delays and unexpected traffic.</p>

        <title>71st Annual Sturgis Rally</title>

        <description><![CDATA[<p>The Motorcycle Lawyer didn’t get a chance to make it out to the 71st Annual Sturgis Rally in South Dakota, did you? If not no worries, here’s what you missed!</p>

To know how the rally got to be what it is today, you have to look back on its origins. In 1936 the forming of the Jackpine Gypsies Motorcycle Club is what started it all. Once they were officially chartered by the American Motorcycle Association a year later, AMA began promoting the events, which started the very first rally in Sturgis on August 14, 1938. With only nine racers that year, it’s amazing to see the growth and support this rally has had to the present day. On the 40 acres that the club owns there is a light short track, motocross track, field meet area, hill climb area, clubhouse, office and state approved concession. (<a href="http://www.sturgis.com">www.sturgis.com</a>).<br />
&#160;</p>
<p>Just how big is this 71 year old rally? In attendance in 2008 were 400,000, 66 marriage licenses were issued, and 697 vendors were present. Can’t wait to see what the stats were from this year!&#160; With such a large population to entertain, the rally has an on-going wide range of events. Just some of the events that attendees enjoyed this year were swapping Harley Davidson parts, machine gun shooting, fire dancers, World’s Biggest Biker Pool at 5,000 sq ft., “Burn-Out –In-The Sky," Star Boyz-Stunt Riders, The World Pickle Lickin’ Federations World Champion Contest, World Famous Coleslaw Wrestling,&#160;AMD World Championship of Custom Bike Building,&#160;sky diving, checking out the latest custom bikes, tons of races and concerts, and even getting a souvenir tattoo!<br />
&#160;</p>
<p>For 30 years now Buffalo Chip’s has been a part of the Sturgis Rally and to celebrate they pulled together a concert line-up to remember. Acts from this past rally included Alice Cooper, Styx, Buckcherry, Def Leppard, Poison, Lynyrd Skynyrd, and&#160; Puddle of Mudd, just to name a few.</p>

And if that isn’t enough, what could be greater than getting married in the great outdoors at a bike rally? Not much so thinks Mary-Maisey Ireland, wedding officiate and ceremony planner for weddings at Sturgis. Weddings are officiated year round in the Black Hills. Ireland works hard to make the ceremony personal by asking couples for little details like a favorite poem, song, etc.&#160; And what better way to celebrate after than returning to a rally of 400,000!<br />

        <title>Thermahelm Helmets Could Prevent Head Injury Using Cooling Technology</title>

        <description><![CDATA[<p>The Motorcycle Lawyer recently discovered a new company Thermahelm which claims their helmets to be the airbags of motorcycles, and they’re so cool they will literally put you on “ICE.”</p>
<p><br />
Thermahelm essentially is a helmet that upon impact acts as a cooling pack for the brain. Brain injuries are the leading cause of death in motorcycle accidents, which are typically due to swelling of the brain and medical response time. The thermahelm helmet claims to reduce brain swelling by keeping the brain cool for up to 45 minutes, allotting more time for emergency response.</p>
<p><br />
Invented by neuro-protective specialist Julian Preston Powers in 2005, the basic science of the helmet is that it contains polystyrene foam, which is found in all helmets; the same foam used in walls, refrigerators and portable coolers. This specific foam is a great energy absorber in the event of an accident; however also being an insulator it can cause over heating for the wearer. Powers’ helmet combines this foam technology with two chemical packs in the lining. The first pack contains ammonium nitrate and the other water. When an accident occurs and the helmet is impacted the packs mix to create a cooling reaction which will stabilize temperature of the brain and ease swelling.</p>

The first round of helmets sold out when they were introduced in Britain for 999 pounds or 450 US dollars. Even with such a huge initial success, some consumers are skeptical. One reaction is that “anything like this distracts from the central message which is don’t have the accident in the first place, be careful, and…you’ve got to have consideration for motorcyclists,” says Iam Mutch of the Motorcycle Action Group in Daily Tech's “Thermahelm Motorcycle Helmet Helps Prevent Injury by Inducing Brain Freeze.” Others like Martin Dugard British Speedway racer, believe it’s important to protect yourself, especially the head.&#160;<br />

<p>Beyond the safety aspects of Thermahelm’s helmets, they’ve extended their cooling technology to comfort levels for motorcyclists as well with their ICE system (Internal Cooling/Extraction). This system consists of tubing which when activated releases compressed gas which can significantly cool the head by several degrees in a matter of seconds. This makes the rider more comfortable on hot summer days, but again promotes safety by helping riders stay concentrated in warmer weather conditions. The network of cooling tubes can be activated by a trigger which can be placed in any convenient spot for the rider. Some models even come with a built in GPS system which is traceable in the event of an accident, increasing medical response time.<br />

        <title>H-D Dealer Helps Educate About Motorcycle Noise Restrictions</title>

<p>In New Hampshire, as unlikely as it seems, Seacoast Harley-Davidson has teamed up with local law enforcement to help enforce the mandated decibel level and educate non-bikers about the actual parameters of the laws and many misconceptions that the volume of noise they are hearing is not actually in violation of the law.<br />
&#160;</p>
<p>New Hampshire’s maximum decibel level for motorcycle exhausts is 106 decibels.&#160; Most local bikers have no problem complying with the level set by the state, however, some continue to use modified exhausts that exceed the maximum decibels and risk an $84 ticket.&#160; At a press conference held at Seacoast H-D, police officials said they are considering suspending motorcycle registrations of repeat offenders as further incentive to comply with the law.<br />
&#160;</p>
<p>Seacoast Harley-Davidson helped fund the noise campaign including printing brochures explaining commonly misunderstood motorcycle laws.&#160; They have even gone as far as putting up posters outside the dealership saying “Motorcycle Noise Annoys.”&#160;&#160; The owner says that they “want to educate owners and the public about what legal motorcycle exhaust is.”&#160; All motorcycles sold at their dealership are compliant with the law, as are most all motorcycles registered in general; a lot of the complaints are “perception problems.”&#160;<br />
&#160;</p>
<p>The belief of Seacoast and New Hampshire police is that this partnership will help them come up with a solution locally that will meet everyone’s needs.&#160; In the 2010 ballot a group of citizens successfully created an ordinance that stated in the town of Hampton, motorcycles could not exceed 82 decibels.&#160; North Hampton Police Chief Brian Page says that is it common knowledge, however, that he will not enforce this ordinance because it is overridden by state law.&#160; He wants to make sure he is being fair to the citizens of Hampton as well as all motorcyclists passing through.<br />

        <title>Blue Law Repeal In New Jersey Allows Motorcycle Sales On Sunday</title>

        <description><![CDATA[<p>Some of you may know about the very old Blue Laws that banned the sale of motorcycles (among other things) on Sundays in the United States.&#160; Did you also know that a few of our states still upheld these laws?&#160; Up until last week, New Jersey was one of these states.&#160; Many New Jersey business owners, like Barb Borowiec, owner of Barb’s Harley Davidson, lost business because people couldn’t buy a motorcycle at her shop on Sundays.&#160; Tons of potential customers have full-time jobs on the weekdays which left only Saturdays to purchase a bike, a day which was usually crazy busy at motorcycle shops across the state.&#160; This prompted eager buyers to cross state lines and purchase their products at neighboring states like Delaware and New York, which allow the Sunday sales.&#160; In an economy that is already struggling, losing a day of business can be a hard hit.&#160; Borowiec said she still had her shop open on Sundays so customers could buy accessories and take riding classes but serious buyers had to be turned away until Monday.&#160; Barb could not see any reason for the ban especially when liquor, cigarettes, and gambling are still available on the seventh day.&#160; For six years the business owner wrote letters to New Jersey lawmakers and then finally, on March 3rd, Governor Chris Christie signed a bill into law that repeals the ancient Blue Law and now allows the sale of motorcycles on Sunday.&#160; The bill was sponsored by Senator Donald Norcross, D-Camden, whose office is right by Barb’s Harley-Davidson shop.&#160; The change of law will not affect the ban on Sunday sales of automobiles and will not apply in Bergen County (across the Hudson River from New York) where Blue Laws still prohibit the sale of almost all non-essential items on Sundays.&#160;<br />
The states that currently ban all automobile sales, including motorcycles, on Sundays are Colorado, Illinois, Indiana, Iowa, Louisiana, Maine, Minnesota, Missouri, Oklahoma, North Dakota, Pennsylvania, and Wisconsin<br />
Maryland, Michigan, Texas and Utah have certain restrictions banning some counties from automobile and motorcycle sales on Sunday but not others.<br />

        <content:encoded><![CDATA[<p>Some of you may know about the very old Blue Laws that banned the sale of motorcycles (among other things) on Sundays in the United States.&#160; Did you also know that a few of our states still upheld these laws?&#160; Up until last week, New Jersey was one of these states.&#160; Many New Jersey business owners, like Barb Borowiec, owner of Barb’s Harley Davidson, lost business because people couldn’t buy a motorcycle at her shop on Sundays.&#160; Tons of potential customers have full-time jobs on the weekdays which left only Saturdays to purchase a bike, a day which was usually crazy busy at motorcycle shops across the state.&#160; This prompted eager buyers to cross state lines and purchase their products at neighboring states like Delaware and New York, which allow the Sunday sales.&#160; In an economy that is already struggling, losing a day of business can be a hard hit.&#160; Borowiec said she still had her shop open on Sundays so customers could buy accessories and take riding classes but serious buyers had to be turned away until Monday.&#160; Barb could not see any reason for the ban especially when liquor, cigarettes, and gambling are still available on the seventh day.&#160; For six years the business owner wrote letters to New Jersey lawmakers and then finally, on March 3rd, Governor Chris Christie signed a bill into law that repeals the ancient Blue Law and now allows the sale of motorcycles on Sunday.&#160; The bill was sponsored by Senator Donald Norcross, D-Camden, whose office is right by Barb’s Harley-Davidson shop.&#160; The change of law will not affect the ban on Sunday sales of automobiles and will not apply in Bergen County (across the Hudson River from New York) where Blue Laws still prohibit the sale of almost all non-essential items on Sundays.&#160;<br />
The states that currently ban all automobile sales, including motorcycles, on Sundays are Colorado, Illinois, Indiana, Iowa, Louisiana, Maine, Minnesota, Missouri, Oklahoma, North Dakota, Pennsylvania, and Wisconsin<br />
Maryland, Michigan, Texas and Utah have certain restrictions banning some counties from automobile and motorcycle sales on Sunday but not others.<br />

        <description><![CDATA[<p>For fellow bikers that are heading down to Daytona Bike Week, we want to give you a warning about traveling through Georgia.&#160; A $70,000 federal grant was awarded to the state to set up motorcycle only checkpoints.&#160; Bikers will be instructed by portable road signs to pull off the road where they will be inspected for a properly endorsed license, a DOT approved helmet, and the condition of their bikes including good tires, and working headlights &amp; taillights.&#160; The checkpoints have been reported to be operating from 8am to 5pm on I-75 at the vehicle inspection station in Monroe County and on I-95 in Chatham County.</p>
<p>While discussions about these types of checkpoints have gotten very heated, it's best to abide by Georgia's laws while passing through to bike week.&#160; The estimated delay for bikers with proper equipment and endorsements should only be a few minutes.</p>]]></description>

        <description><![CDATA[<p>Recently, The Motorcycle Lawyer was informed that the Pennsylvania Department of Transportation (DOT) has created a program to provide FREE safety training to motorcyclists.&#160; Anyone with a motorcycle permit or license can enroll in the Motorcycle Safety Program at 70 different locations throughout the state.&#160; It's a 15 hour basic skills course where motorcycles and gear are provided.&#160; Once passed, the rider can enroll in the 6 hour Basic Rider 2 course (for experienced riders).&#160; In the advanced course you must provide your own motorcycle and gear and the student is permitted to practice riding with a passenger.&#160; To learn more about these courses or to enroll please visit <a href="http://www.pamsp.com/">http://www.pamsp.com/</a></p>]]></description>

        <title>CA Police Patrol on Electric Motorcycles</title>

        <description><![CDATA[<p>The Motorcycle Lawyer just heard that Zero Motorcycles, maker of electric bikes, delivered one of its DS models to the Scotts Valley Police Department.&#160; They are the first police department to use electric motorcycles for patrol in the United States.&#160; Many cities have adapted to using hybrid cars in their fleets to help reduce fuel costs and other expenses.&#160; John Hohmann, a lieutenant with&#160;the Scotts Valley Department stated "We are excited to be the first police department in California to receive and electric Zero motorcycle because it will allow our officers to patrol more places, more often."&#160; The Zero is highway-legal and has a range of 50 miles.&#160; Working with the Scotts Valley Police will be a great test for this company's product.</p>]]></description>

        <title>Stricter Requirements for Motorcycle License in N.C.</title>

        <description><![CDATA[<p>The Motorcycle Lawyer recently learned that as of January 1st new laws have come in to affect that will increase requirements for bikers in North Carolina to get their motorcycle endorsement.&#160; Previously, potential riders in N.C. could obtain a permit after passing only a written test.&#160; This permit expired after 18 months but could be renewed indefinitely.&#160; The new law will require all riders under the age of 18&#160;to pass a safety course and a road test before getting a permit.&#160; The new permit will only be valid for 12 months and there is only the possibility of one 6 month extension.&#160; These new laws are being enforced after officials realized that North Carolina was one of the few states with an increase in motorcycle fatalities while the rest of the country had a decrease.&#160; N.C. officials are contributing lack of safety training and inexperienced riders to the 29% rise.</p>
<p>If these new requirments prove to make a difference I'm sure we can expect to see laws like this popping up throughout the country.</p>

        <description><![CDATA[<p>The National Transportation Safety Board (NTSB) has been making lots of updates to their "Most Wanted&#160;List" for the coming year.&#160; A huge&#160;bonus for The Motorcycle Lawyer and all fellow bikers is that they have replaced recreational boating safety with <strong>motorcycle safety.&#160;</strong> Finally our national government is realizing how important the safety of motorcyclists is.&#160; "The List" is being directed at state governments which can best improve transportation in many specific areas.</p>]]></description>
