Ø      Maine is an At-Fault state. This means that the at-fault driver in your Maine motorcycle accident will be held accountable for injuries resulting from your Maine motorcycle accident. The law of negligence governs claims in at-fault states.

 

Ø      Maine Helmet Law:

·        Helmet required for under age 15.

·        Required if operating under learner’s permit.

·        Required if operating less than one year with license/endorsement.

·        Required as a passenger if operator is required to wear a helmet.

 

Title 29-A. Motor Vehicles. Chapter 19. Operation. Subchapter I. Rules of the Road. Section 2083. Protective Headgear. 1. Requirement:

 

"The following persons must wear protective headgear :

"A. If under 15 years of age, a passenger on a motorcycle, motor-driven cycle or an attached side car;

"B. If under 15 years of age, an operator of an off-road motorcycle or motor-driven cycle;

"C. An operator of a motorcycle or motor-driven cycle, operating under a learner's permit or within one year of successfully completing a driving test; and

"D. A passenger of an operator required to wear headgear."

Ø      Maine Eye Protection: When operating or riding on a Maine motorcycle, it is not required by law that you wear eye protection.

Ø      Maine Statute of Limitations: If you are injured in a Maine motorcycle accident, you must commence suit within 6 years from the date of your Maine motorcycle accident.

TITLE 14: COURT PROCEDURE – CIVIL: Part 2: PROCEEDINGS BEFORE TRIAL

Chapter 205: LIMITATION OF ACTIONS – Subchapter1: GENERAL PROVISIONS

§752. 6 YEARS.

All Civil actions shall be commenced within 6 years after the cause of action accrues and not afterwards, except actions on a judgment or decree of any court of record of the United States, or of any state, or of a justice of the peace in this State, and except as otherwise specially provided.

Ø      Maine Minimum Motorcycle Insurance Requirements:  In Maine, Compulsory Liability Insurance is required for your Maine motorcycle.

·        Bodily Injury Liability (1 Person): $50,000

·        Bodily Injury Liability (All persons): $100,000

·        Property Damage Liability: $25,000

·        + $1,000/Person for Medical Payments

 

Ø      Maine Uninsured & Underinsured Motorist Coverage:

·        Uninsured Motorist Coverage: Uninsured motorist coverage will cover your injuries when you are involved in a Maine motorcycle accident with an at-fault driver who has no car liability insurance.

·        Uninsured Motorist Coverage will also cover you if you are involved and injured in a Maine motorcycle accident with an at-fault hit & run driver.

·        Underinsured Motorist Coverage: Underinsured motorist coverage will cover injuries resulting from your Maine motorcycle accident with an at-fault driver who has inadequate or insufficient liability insurance to cover your damages.

·        Medical Payments Coverage: If you are injured in a Maine motorcycle accident, Medical Payments Coverage will pay for medical and funeral expenses for you, or others injured in your Maine motorcycle accident.

o       Reasonable medical bills

o       Covers you or members or your family if hit as a pedestrian
