Ø      Nevada is an at-fault state. This means that the law of negligence governs Nevada motorcycle and Nevada motor vehicle accidents. The person who is found to be “at fault” for the Nevada motorcycle accident can be held accountable for your injuries and damages in your Nevada motorcycle accident.

 

Ø      Nevada Motorcycle Definition: The following statute provides the definition of a Nevada motorcycle –

 

NRS 486.041  “Motorcycle” defined.  

Motorcycle” means every motor vehicle equipped with a seat or a saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, including a power cycle but excluding a tractor and a moped.

 

Ø      Nevada Helmet Law: If you are riding on or operating a Nevada motorcycle, you are required by law to wear a helmet.

 

Ø      Nevada Eye Protection Law: If you are riding on or operating a Nevada motorcycle, you are required by law to wear eye protection, unless the Nevada motorcycle is equipped with a windscreen.

 

N.R.S.486.231:

Title 43. Public Safety; Vehicles; Watercraft

Chapter 486. Motorcycles and Similar Vehicles

Operation and Equipment

Protective headgear and glasses: Standards; when use required.

 

1. The department shall adopt standards for protective headgear and protective glasses, goggles or face shields to be worn by the drivers and passengers of motorcycles and transparent windscreens for motorcycles.

 

2. Except as provided in this section, when any motorcycle, except a trimobile or moped, is being driver on a highway, the driver and passenger shall wear protective headgear securely fastened on the head and protective glasses, goggles or face shields meeting those standards. Drivers and passengers of trimobiles shall wear protective glasses, goggles, or face shields which meet those standards.

 

3. When a motorcycle or a trimobile is equipped with a transparent windscreen meeting those standards, the driver and passenger are not required to wear glasses, goggles or face shields.

 

Ø      Nevada Motorcycle License: In Nevada, you are required to have a motorcycle license before operating a Nevada motorcycle.

 

NRS 486.061  

License required to operate motorcycle or trimobile; exception.  

 

Except for a nonresident who is at least 16 years of age and is authorized by the state of his residency to drive a motorcycle, a person shall not drive:

 

1.  A motorcycle, except a trimobile, upon a highway unless that person holds a valid motorcycle driver’s license issued pursuant to NRS 486.011 to 486.381, inclusive, or a driver’s license issued pursuant to chapter 483 of NRS endorsed to authorize the holder to drive a motorcycle.

 

Ø      Nevada Motorcycles and Nevada Minors: The following statute describes the process for minors in Nevada to obtain a Nevada motorcycle license:

 

NRS 486.101  

Application of minors.

 

1.  The application of any person under the age of 18 years for a motorcycle driver’s license must be signed and verified, before a person authorized to administer oaths, by either or both the father or mother of the applicant, if either or both are living and have custody of him, or if neither parent is living, then by the guardian having custody, or by an employer of the minor, or if there is no guardian or employer, then by any responsible person who is willing to assume the obligation imposed pursuant to NRS 486.011 to 486.381, inclusive, upon a person signing the application of a minor.

 

2.  Any negligence or willful misconduct of a minor under the age of 18 years when driving a motorcycle upon a highway is imputed to the person who signed the application of the minor for a license. That person is jointly and severally liable with the minor for any damages caused by negligence or willful misconduct.

 

Ø      Nevada Motorcycle Insurance: If you own a Nevada motorcycle, you are required by law to insure your Nevada motorcycle. The minimum insurance required for your Nevada motorcycle is Compulsory Liability. The limits for your Nevada motorcycle insurance are 15/30/10.

 

·        Minimum Bodily Liability Insurance (1 Person): $15,000

·        Minimum Bodily Liability Insurance (All persons, 1 Accident): $30,000

·        Minimum Property Damage Liability Insurance: $10,000

 

N.R.S. 485.3091

485.3091. Motor vehicle liability policy: Requirements


1. An owner's policy of liability insurance must:

(a) Designate by explicit description or by appropriate reference all motor vehicles with respect to which coverage is thereby to be granted; and

(b) Insure the person named therein and any other person, as insured, using any such motor vehicle with the express or implied permission of the named insured, against loss from the liability imposed by law for damages arising out of the ownership, maintenance or use of such motor vehicle within the United States of America or the Dominion of Canada, subject to limits exclusive of interest and costs, with respect to each such motor vehicle, as follows:

(1) Because of bodily injury to or death of one person in any one accident, $15,000;

(2) Subject to the limit for one person, because of bodily injury to or death of two or more persons in any one accident, $30,000; and

(3) Because of injury to or destruction of property of others in any one accident, $10,000.

 

Ø      Nevada Motorcycle Uninsured Motorist Coverage: If you are injured in a Nevada motorcycle accident, by an at-fault driver who has inadequate or no insurance to cover your claims, uninsured motorist coverage may protect you in this situation.

690B.020. Uninsured or hit-and-run vehicles; insolvency of insurer

 

3. For the purposes of this section , the term "uninsured motor vehicle" means a motor vehicle:

(a) With respect to which there is not available at the department of motor vehicles evidence of financial responsibility as required by chapter 485 of NRS;

(b) With respect to the ownership, maintenance or use of which there is no liability insurance for bodily injury or bond applicable at the time of the accident, or, to the extent of such deficiency, any liability insurance for bodily injury or bond in force is less than the amount required by NRS 485.210;

(c) With respect to the ownership, maintenance or use of which the company writing any applicable liability insurance for bodily injury or bond denies coverage or is insolvent;

(d) Used without the permission of its owner if there is no liability insurance for bodily injury or bond applicable to the operator;

(e) Used with the permission of its owner who has insurance which does not provide coverage for the operation of the motor vehicle by any person other than the owner if there is no liability insurance for bodily injury or bond applicable to the operator; or

(f) The owner or operator of which is unknown or after reasonable diligence cannot be found if:

(1) The bodily injury or death has resulted from physical contact of the automobile with the named insured or the person claiming under him or with an automobile which the named insured or such a person is occupying; and

(2) The named insured or someone on his behalf has reported the accident within the time required by NRS 484.223, 484.225 or 484.227 to the police department of the city where it occurred, or if it occurred in an unincorporated area, to the sheriff of the county or to the Nevada highway patrol.

 

N.R.S. 687B.145

687B.145. Provisions in policies of casualty insurance: Proration of recovery or benefits; uninsured and underinsured motorist coverage; coverage for medical expenses; insurer not entitled to subrogation upon payment made because of underinsured vehicle coverage

2. Except as otherwise provided in subsection 5, insurance companies transacting motor vehicle insurance in this state must offer, on a form approved by the Commissioner, uninsured and underinsured vehicle coverage in an amount equal to the limits of coverage for bodily injury sold to an insured under a policy of insurance covering the use of a passenger car. The insurer is not required to reoffer the coverage to the insured in any replacement, reinstatement, substitute or amended policy, but the insured may purchase the coverage by requesting it in writing from the insurer. Each renewal must include a copy of the form offering such coverage. Uninsured and underinsured vehicle coverage must include a provision which enables the insured to recover up to the limits of his own coverage any amount of damages for bodily injury from his insurer which he is legally entitled to recover from the owner or operator of the other vehicle to the extent that those damages exceed the limits of the coverage for bodily injury carried by that owner or operator. If an insured suffers actual damages subject to the limitation of liability provided pursuant to NRS 41.035, underinsured vehicle coverage must include a provision which enables the insured to recover up to the limits of his own coverage any amount of damages for bodily injury from his insurer for the actual damages suffered by the insured that exceed that limitation of liability.


Ø      Nevada Statute of Limitations: If you wish to commence suit as a result of your Nevada motorcycle accident, you must do so within 2 years from the date of your Nevada motorcycle accident.

 

NRS 11.190  

Periods of limitation.  

Except as otherwise provided in NRS 125B.050 and 217.007, actions other than those for the recovery of real property, unless further limited by specific statute, may only be commenced as follows:

 

4.  Within 2 years:.

(e) Except as otherwise provided in NRS 11.215, an action to recover damages for injuries to a person or for the death of a person caused by the wrongful act or neglect of another. The provisions of this paragraph relating to an action to recover damages for injuries to a person apply only to causes of action which accrue after March 20, 1951.
