New Hampshire Motorcycle Laws*

 

New Hampshire motorcyclists are protected under New Hampshire motorcycle law that makes negligent drivers responsible and liable to New Hampshire motorcyclists. Ø      New Hampshire is an at-fault state. This means that the law of negligence governs New Hampshire motorcycle and New Hampshire motor vehicle accidents. N.H. Rev. Stat. § 259:63

259:63 Motorcycle.
Motorcycle” shall mean every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than 3 wheels in contact with the ground, but excluding tractors and mopeds. The term shall also include 3-wheel scooters with enclosed cabs.

 

Ø      New Hampshire Motorcycle Helmet Law: If you are riding on or operating a New Hampshire motorcycle, and you are under the age of 18, you are required by law to wear a helmet.

 

Title XXI. Motor Vehicles. Chapter 265. Rules of the Road, Special Rules for Motorcycles. Section 265.122 Protective Headgear.

 

I. No person less than 18 years of age may drive or ride upon a motorcycle unless he wears protective headgear of a type approved by the director. Such headgear shall be equipped with either a neck or chin strap.

 

Ø      New Hampshire Motorcycle Eye Protection Law: If you are riding on or operating a New Hampshire motorcycle, you are required by law to wear eye protection, unless the New Hampshire motorcycle is equipped with a wind screen.

 

N.H. Rev. Stat. § 265:123

265:123 Eye and Face Protection.


If a motorcycle is not equipped with a windshield or screen which protects the driver’s eyes and face when the driver is sitting erect, the driver shall wear either eyeglasses, goggles or a protective face shield when driving the motorcycle while the motorcycle is in motion.

Ø      New Hampshire Motorcycle Minimum Insurance Requirements: In the state of New Hampshire, you are required to have insurance for your New Hampshire motorcycle. The minimum insurance required for your New Hampshire motorcycle is Compulsory Liability Insurance, and the minimum limits required are 25/50/25.

·        Bodily Injury Liability (1 Person): $25,000

·        Bodily Injury Liability (All Persons, 1 Accident): $50,000

·        Property Damage Liability: $25,000

 

N.H. Rev. Stat. § 259:61

259:61 Motor Vehicle Liability Policy.
Motor vehicle liability policy” shall mean a policy of liability insurance which provides:

I. Indemnity for or protection to the insured and any person responsible to him for the operation of the insured's motor vehicle, trailer, or semi-trailer who has obtained possession or control thereof with his express or implied consent, against loss by reason of the liability to pay damages to others for damage to property, except property of others in charge of the insured or his employees, or bodily injuries, including death at any time resulting therefrom, accidentally sustained during the term of said policy by any person other than the insured, or employees of the insured actually operating the motor vehicle or such other person responsible as aforesaid who are entitled to payments or benefits under the provisions of any workers' compensation act arising out of the ownership, operation, maintenance, control, or use within the limits of the United States of America or the Dominion of Canada of such motor vehicle, trailer or semi-trailer, to the amount or limit of at least $25,000 on account of injury to or death of any one person, and subject to such limit as respects injury or death of one person, of at least $50,000 on account of any one accident resulting in injury to or death of more than one person, and at least $25,000 for damage to property of others, as herein provided, or a binder pending the issue of such a policy or an endorsement to an existing policy, as defined in RSA 264:14, 18, and 19, and

II. Which further provides indemnity for or protection to the named insured and to the spouse of such named insured as insured if a resident of the same household, or the private chauffeur or domestic servant acting within the scope of the employment of any such insured with respect to the presence of any such insured in any other motor vehicle, from liability as a result of accidents which occur in New Hampshire due to the driving of any motor vehicle, trailer, or semi-trailer not owned in whole or in part by such insured; provided, however, the insurance afforded under this paragraph applies only if no other valid and collectible insurance is available to the insured.

III. The coverages described in paragraphs I and II, except as to the minimum financial responsibility limits, shall not apply to any insured operator whose driver's license has been suspended or revoked. Coverage under RSA 264:15 or RSA 264:16 shall not apply to any insured operator whose driver's license has been suspended or revoked.

Ø      New Hampshire UM Coverage: If you are involved in a New Hampshire motorcycle accident with an at-fault driver who has inadequate or no insurance to cover your claims, you may protect yourself by carrying uninsured or underinsured motorist coverage.

Ø      New Hampshire Statute of Limitations: If you are injured in a New Hampshire motorcycle accident, and you wish to commence suit against the at-fault driver, you have a statute of limitations, or time period, in which you must do so. The statute of limitations for filing suit due to your New Hampshire motorcycle accident is 3 years from the date of the accident.

 

N.H. Rev. Stat. § 508:4

508:4 Personal Actions
I. Except as otherwise provided by law, all personal actions, except actions for slander or libel, may be brought only within 3 years of the act or omission complained of, except that when the injury and its causal relationship to the act or omission were not discovered and could not reasonably have been discovered at the time of the act or omission, the action shall be commenced within 3 years of the time the plaintiff discovers, or in the exercise of reasonable diligence should have discovered, the injury and its causal relationship to the act or omission complained of.
