NEW YORK MOTORCYCLE LAWS*

§ 381. Motorcycle equipment

6. It shall be unlawful for any person to operate or ride upon a motorcycle unless he wears a protective helmet of a type which meets the requirements set forth in section 571.218 of the federal motor vehicle safety standards as may from time to time be amended. The commissioner is hereby authorized and directed to adopt regulations for helmets which are consistent with the requirements as specified in section 571.218 of the federal motor vehicle safety standards as may from time to time be amended. The police authorities of a city, town or village may issue a permit exempting members of organizations sponsoring or conducting parades or other public exhibitions from the provisions of this subdivision while such members are participating in such parades or other public exhibitions.

§ 381. Motorcycle equipment

7. It shall be unlawful, on and after January first, nineteen hundred sixty-seven, for any person to operate a motorcycle unless he wears goggles or a face shield of a type approved by the commissioner. The commissioner is hereby authorized and empowered to adopt and amend regulations covering types of goggles and face shields and the specifications therefor and to establish and maintain a list of approved goggles and face shields which meet the specifications as established hereunder.

 

Ø      Definition of “Motorcycle” in New York:

 

McKinney's Vehicle and Traffic Law § 123

Vehicles Defined as a Motorcycle

This section defines a motorcycle as a motor vehicle having a seat or saddle for the use of a rider and designed to travel on not more than three wheels in contact with the ground. Other motor vehicles defined as a motorcycle include: all-terrain vehicles (ATVs), Nationwide Mut. Ins. Co. v. Riccadulli, 183 A.D.2d 111, 589 N.Y.S.2d 356 (2 Dept., 1992); Tri-sport vehicles, which have three wheels, a two cylinder 21-horsepower engine and which can attain speeds of 65 miles per hour, Moses v. National Grange Mut. Ins. Co., 89 Misc.2d 106, 390 N.Y.S.2d 575 (1977); and minibikes. Tyler v. Travelers Ins. Co., 110 Misc.2d 471, 442 N.Y.S.2d 746 (1981).

 

*New York No-Fault law does NOT extend to cover New York motorcycle accidents. A New York motorcycle accident is a straight tort claim. A New York motorcyclist who is injured in a New York motorcycle accident with another motor vehicle may make a tort claim to recover economic losses as well as for pain and suffering, if a threshold injury is met. A New York motorcyclist is not entitled to No-Fault benefits for their New York motorcycle accident.

 

The following law applies to New York motorists that are involved in a motor vehicle accident.

 

Ø      New York is a No-Fault state.  

 

§ 5104. Causes of action for personal injury
(a) Notwithstanding any other law, in any action by or on behalf of a covered person against another covered person for personal injuries arising out of negligence in the use or operation of a motor vehicle in this state, there shall be no right of recovery for non-economic loss, except in the case of a serious injury, or for basic economic loss. The owner, operator or occupant of a motorcycle which has in effect the financial security required by article six or eight of the vehicle and traffic law, or which is referred to in subdivision two of section three hundred twenty-one of such law, shall not be subject to an action by or on behalf of a covered person for recovery for non-economic loss, except in the case of a serious injury, or for basic economic loss.

(b) In any action by or on behalf of a covered person, against a non-covered person, where damages for personal injuries arising out of the use or operation of a motor vehicle or a motorcycle may be recovered, an insurer which paid or is liable for first party benefits on account of such injuries has a lien against any recovery to the extent of benefits paid or payable by it to the covered person. No such action may be compromised by the covered person except with the written consent of the insurer, or with the approval of the court, or where the amount of such settlement exceeds fifty thousand dollars. The failure of such person to commence such action within two years after accrual gives the insurer a cause of action for the amount of first party benefits paid or payable against any person who may be liable to the covered person for his personal injuries. The insurer's cause of action shall be in addition to the cause of action of the covered person except that in any action subsequently commenced by the covered person for such injuries, the amount of his basic economic loss shall not be recoverable.

(c) Where there is no right of recovery for basic economic loss, such loss may nevertheless be pleaded and proved to the extent that it is relevant to the proof of non-economic loss.

 

Ø      What constitutes a “serious” injury?

 

  • Threshold Injury Requirement:  Permanent, serious injury required to recover non-economic damages as a result of New York motorcycle crash.

New York law allows you to sue for pain & suffering that occurred as a result of your New York motorcycle accident, if you have sustained a “serious injury”.

 

Article 51. Comprehensive Motor Vehicle Insurance Reparations (Refs & Annos)

§ 5102. Definitions

 

(c) "Non-economic loss" means pain and suffering and similar non-monetary detriment.

(d) "Serious injury" means a personal injury which results in death; dismemberment; significant disfigurement; a fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; significant limitation of use of a body function or system; or a medically determined injury or impairment of a non-permanent nature which prevents the injured person from performing substantially all of the material acts which constitute such person's usual and customary daily activities for not less than ninety days during the one hundred eighty days immediately following the occurrence of the injury or impairment.

 

Ø      Serious Injuries may include, but are not limited to:

·        Serious Permanent Disfigurement

·        Facial Disfigurement with Visible Scarring

·        Loss of Limb

·        Fracture of Bone

·        Loss of Use of Body Organ and/or System

·        Significant Limitation of Body Function and/or Body System

·        Loss of Fetus

·        Death

 

Ø      New York Statute of Limitations:  There is a 3 year statute of limitations in New York in which to recover for personal injury, non-economic damages as a result of your New York motorcycle accident.

 

-To claim No-Fault benefits under New York law you must file a written application with the insurance company within 30 days of your New York motorcycle accident.

 

Ø      New York No-Fault Benefits:

 

·        Medical Expenses, Past & Future

·        Hospital Expenses

·        Lost Wages            (see statute for specifics)

·        New York No-Fault policies are required by law to provide total coverage of $50,000 for both medical costs & lost wages.

 

N.Y. Comp. Codes R. & Regs. tit. 11, § 65-1.1


First-party benefits, other than death benefits, are payments equal to basic economic loss, reduced by the following:

(a) 20 percent of the eligible injured person's loss of earnings from work to the extent that an eligible injured person's basic economic loss consists of such loss of earnings;

(b) amounts recovered or recoverable on account of personal injury to an eligible injured person under State or Federal laws providing social security disability or workers' compensation benefits, or disability benefits under article 9 of the New York Workers' Compensation Law;

(c) the amount of any applicable deductible, provided that such deductible shall apply to each accident, but only to the total of first-party benefits otherwise payable to the named insured and any relative as a result of that accident.

Basic Economic Loss
Basic economic loss shall consist of medical expense, work loss, other expense and, when death occurs, a death benefit as herein provided. Except for such death benefit, basic economic loss shall not include any loss sustained on account of death. Basic economic loss of each eligible injured person on account of any single accident shall not exceed $50,000, except that any death benefit hereunder shall be in addition thereto.

Medical Expense
Medical expense shall consist of necessary expenses for:

(a) medical, hospital (including services rendered in compliance with Article 41 of the Public Health Law, whether or not such services are rendered directly by a hospital), surgical, nursing, dental, ambulance, X-ray, prescription drug and prosthetic services;

(b) psychiatric, physical and occupational therapy and rehabilitation;

(c) any non-medical remedial care and treatment rendered in accordance with a religious method of healing recognized by the laws of New York; and

(d) any other professional health services.

These medical expenses will not be subject to a time limitation, provided that, within one year after the date of the accident, it is ascertainable that further medical expenses may be sustained as a result of the injury. Payments hereunder for necessary medical expenses shall be subject to the limitations and requirements of section 5108 of the New York Insurance Law.

Work Loss
Work loss shall consist of the sum of the following losses and expenses, up to a maximum payment of $2,000 per month for a maximum period of three years from the date of the accident:

(a) loss of earnings from work which the eligible injured person would have performed had such person not been injured, except that an employee who is entitled to receive monetary payments, pursuant to statute or contract with the employer, or who receives voluntary monetary benefits paid for by the employer, by reason of such employee's inability to work because of personal injury arising out of the use or operation of a motor vehicle or a motorcycle, shall not be entitled to receive first-party benefits for loss of earnings from work to the extent that such monetary payments or benefits from the employer do not result in the employee suffering a reduction in income or a reduction in such employee's level of future benefits arising from a subsequent illness or injury; and

(b) reasonable and necessary expenses sustained by the eligible injured person in obtaining services in lieu of those which such person would have performed for income.

Other Expenses

Other expenses shall consist of all reasonable and necessary expenses, other than medical expense and work loss, up to $25 per day for a period of one year from the date of the accident causing injury.

Death Benefit
Upon the death of any eligible injured person, caused by an accident to which this coverage applies, the company will pay to the estate of such person a death benefit of $2,000.
