WYOMING MOTORCYCLE LAWS*

 

Wyoming motorcyclists are protected under Wyoming motorcycle law that makes negligent drivers responsible and liable to Wyoming motorcyclists. W.S.1977 § 31-1-101

§ 31-1-101. Definitions

 

(E) "Motorcycle" means every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three (3) wheels in contact with the ground but which may have attached thereto a sidecar for the purpose of transporting a single passenger. For the purpose of registration and titling "motorcycle" includes motorized bicycles and scooters, but excludes mopeds, motorized skateboards and off-road recreational vehicles as defined in subparagraph (K) of this paragraph. A recreational vehicle primarily designed for off-road use which is fifty (50) inches or less in width, has an unladen weight of nine hundred (900) pounds or less, has four (4) low pressure tires as defined by subparagraph (K) of this paragraph, is designed to be ridden astride a seat or saddle, and is not a golf cart may be registered and titled under this act and is deemed to be:

 

(I) A motorcycle for the purpose of this act if titled and registered pursuant to this act; or

 

(II) An off-road recreational vehicle under subparagraph (K) of this paragraph if not titled and registered pursuant to this act.

 

 

Ø      Wyoming is an At-Fault state: This means that the law of negligence governs motor vehicle accidents. The person who is found to be “at fault” for the accident can be held accountable for your injuries and damages resulting from your Wyoming motorcycle accident.

 

Ø      Wyoming Comparative Negligence: If you are found to be partially at-fault for your Wyoming motorcycle accident, this may not bar you from recovering for your injuries and damages. Your damages may simply be reduced in proportion to fault percentages from your Wyoming motorcycle accident.

 

Ø      Wyoming Motorcycle Helmet Law: If you are riding on or operating a Wyoming motorcycle, and you are under the age of 18, you are required by law to wear a helmet.

 

Title 31. Motor Vehicles. Chapter 5. Regulation of Traffic on Highways. Article 1. In General. Section 31-5-115. Operation of Motorcycles and Pedestrian Vehicles:

". . . (o) No minor shall operate or ride nor shall the operator permit a minor to ride upon a motorcycle unless he is wearing protective headgear securely fastened on his head, and of a type which complies with standards established by the superintendent. This subsection does not apply to persons riding within an enclosed cab nor to persons operating or riding a moped. This subsection only applies to motorcycles used on public highways, streets and thoroughfares. . . ."

 

Ø      Wyoming Eye Protection Law: There is no law for wearing eye protection when riding on or operating a Wyoming motorcycle.

 

Ø      Wyoming Motorcycle Minimum Insurance Required: The minimum insurance required for your Wyoming motorcycle is compulsory liability insurance.

  • Bodily Injury Liability (1 person): $25,000
  • Bodily Injury Liability (all persons, one accident): $50,000
  • Property Damage Liability: $20,000

 

Ø      Wyoming UIM Coverage: UIM Coverage, either “uninsured” or “underinsured” motorist coverage, will cover you in the event that the other at-fault driver involved in your Wyoming motorcycle accident does not have adequate, or any, insurance to cover your injuries.

 

  • Underinsured Motorist: Underinsured motorist may cover your injuries resulting from your Wyoming motorcycle accident in the event the at-fault party only has the minimum insurance required, and this does not cover your claim.
  • Uninsured Motorist: Uninsured motorist may cover your injuries resulting from your Wyoming motorcycle accident in the event the at-fault party does not have any insurance.
  • Hit & Run: If you are injured in a Wyoming motorcycle accident, and the at-fault driver is unknown or a “hit and run”, uninsured motorist may cover your resulting injuries in this case as well.

Ø      Wyoming Statute of Limitations: To recover for injuries resulting from your Wyoming motorcycle accident, you must commence suit within 4 years from the date of your Wyoming motorcycle accident.

1-3-105. Actions other than recovery of real property

(a) Civil actons other than for the recovery of real property can only be brought within the following periods after the cause of action accrues:  

(iv) Within four (4) years, an action for:

(C) An injury to the rights of the plaintiff, not arising on contract and not herein enumerated;

(ii) Three (3) years after the discovery.
