Data indicates motorcycle accident claims are up in the year since the new motorcycle helmet law enacted. Some claim that the new law is related to this increase. The Michigan helmet law allows motorcyclists to legally ride without wearing a protective helmet so long as certain conditions are met.
According to Hightway Loss Data Institute, there we about 12% more claims related to motorcycle accidents injuries in 2012 than in 2010 and 2011. The average claim in dollars rose from $5,410 to $7,247. This marks a 22% increase in motorcycle accident claim severity since the law change went into effect.
“By allowing some motorcyclists to ride without helmets, this data suggests when they crash, they are more severely injured,” claims David Zuby, chief research officer at the institutes.
The new law in Michigan allows bikers 21 and older to ride without a helmet. Motorcyclists must carry an extra $20,000 in special medical coverage. 28 states, including Michigan, make helmet wearing mandatory for some riders, usually those who are under 18 years old.
Many variables were not considered in the report, including relative motorcycle rider numbers, how many miles the helmet-less motorcyclists rode compared to the number of miles the helmeted riders rode. Motorcycle riding may have increased with passage of the law, from in state bikers choosing to ride more and possibly motorcyclists from other states visiting more frequently due to the helmet law change.
