OKLAHOMA MOTORCYCLE LAWS*

Ø      Oklahoma is an at-fault state. This means that the law of negligence governs motor vehicle accidents. The person who is found to be “at fault” for the accident can be held accountable for your injuries and damages in your Oklahoma motorcycle accident.

 

Ø      Oklahoma Helmet Law:  When riding on, or operating, an Oklahoma motorcycle, if you are under the age of 18 a helmet must be worn by law.

§ 12-609. Motorcycles--Required equipment


B. No person under eighteen (18) years of age shall operate or ride upon any motorcycle unless such person is properly wearing a crash helmet of a type which complies with standards established by 49 C.F.R., Section 571.218.

 

Ø      Oklahoma Eye Protection Law: A person riding on or operating an Oklahoma motorcycle must wear eye protection, unless the Oklahoma motorcycle is equipped with a windscreen.

§ 12-609. Motorcycles--Required equipment

 

2. A windshield of sufficient quality, size and thickness to protect the operator from foreign objects, except that in lieu of such windshield, the operator shall wear goggles or other protective eyewear which meets American National Standards Institute (ANSI) Standard Z87.1 and provides positive retention, or a face shield of material and design to protect the operator from foreign objects

Ø      Oklahoma Statute of Limitations: If you are injured in an Oklahoma motorcycle accident, and wish to bring suit against the at-fault party, this claim must commence within 2 years from the date of your Oklahoma motorcycle accident.

§ 95. Limitation of other actions

 

3. Within two (2) years: An action for trespass upon real property; an action for taking, detaining, or injuring personal property, including actions for the specific recovery of personal property; an action for injury to the rights of another, not arising on contract, and not hereinafter enumerated; an action for relief on the ground of fraud--the cause of action in such case shall not be deemed to have accrued until the discovery of the fraud;

 

Ø      Oklahoma Minimum Insurance Requirements:  There are minimum insurance requirements for your Oklahoma motorcycle. In Oklahoma, the minimum insurance requirements are Compulsory Liability Insurance for your Oklahoma motorcycle.

 

·        Bodily Injury Liability (one person): $10,000

·        Bodily Injury Liability (all persons in one accident): $20,000

·        Property Damage Liability: $10,000

 

Ø      Oklahoma UIM Coverage: Uninsured or Underinsured Motorist Coverage may protect you if you are injured in an Oklahoma motorcycle accident.

 

·        Underinsured Motorist: If you are injured by an at-fault driver who does not have adequate insurance to cover your injuries resulting from your Oklahoma motorcycle accident, underinsured motorist coverage may protect you.

 

·        Uninsured Motorist: If you are injured by an at-fault driver who does not have any insurance to cover your injuries resulting from your Oklahoma motorcycle accident, uninsured motorist coverage may protect you.

 

·        Hit & Run: If you are injured in an Oklahoma motorcycle accident by a hit & run driver, or the at-fault driver is not able to be identified, uninsured motorist coverage may also protect you in this situation.
