Title 32. Motor Vehicles and Traffic Regulation. Chapter 1. Louisiana Highway Regulatory Act. Part IV. Traffic Regulations. Subpart G. Operation of Motorcycles, Motor-driven Cycles and Bicycles. Section 190. Safety Helmets:

(A)(1) No person shall operate or ride upon any motorcycle, motor driven cycle, or motorized bicycle unless the person is equipped with and is wearing on the head a safety helmet of the type and design manufactured for use by operators of such vehicles, which shall be secured properly with a chin strap while the vehicle is in motion. . . ."

 

Ø      Louisiana Eye Protection: Eye protection is required by law when riding on or operating a Louisiana motorcycle, unless motorcycle is equipped with a windscreen.

 

Ø      Louisiana Statute of Limitations: You have one year from the date of your Louisiana motorcycle accident to seek damages for injuries arising out of your Louisiana motorcycle accident.

 

CHAPTER 4.  LIBERATIVE PRESCRIPTION

            SECTION 1.  ONE YEAR PRESCRIPTION

Art. 3492.  Delictual actions

Delictual actions are subject to a liberative prescription of one year.  This prescription commences to run from the day injury or damage is sustained.  It does not run against minors or interdicts in actions involving permanent disability and brought pursuant to the Louisiana Products Liability Act or state law governing product liability actions in effect at the time of the injury or damage.

Ø      Louisiana Motorcycle Minimum Insurance Required: Compulsory Liability Insurance is required for your Louisiana motorcycle.

 

Minimum Insurance Requirements for Louisiana Motorcycle:

·        Bodily Injury Liability (1 Person): $10,000

·        Bodily Injury Liability (All Injured): $20,000

·        Property Damage Liability: $10,000

 

Ø      Louisiana Uninsured & Underinsured Motorist Coverage:

 

·        Uninsured Motorist Coverage: Uninsured motorist coverage will cover your injuries resulting from your Louisiana motorcycle accident with an at-fault driver who does not have insurance.

 

·        Hit & Run: If you are in an accident with an at-fault hit & run driver, uninsured motorist coverage will also compensate you for injuries resulting from your Louisiana motorcycle accident.

 

·        Underinsured Motorist Coverage: Underinsured motorist coverage will cover your injuries if you are involved in a Louisiana motorcycle accident with an at-fault driver who does not have adequate insurance to cover your damages. This is often the case when the at-fault driver that caused your Louisiana motorcycle accident has only the minimum insurance requirements.
